Section 2 – Products

2.1 Products

The Products offered for sale by Bacarella are those that appear on the Site, on the day the User consults the Site and within the limits of available stocks. In case of unavailability of one of the Products, the customer will be informed as soon as possible. The photographs and texts illustrating the Products do not enter into the contractual field.

2.2 Resale of Bacarella products

Resale of Bacarella products is not permitted. Repackaging of Bacarella products for resale under another brand is not permitted.

Section 3 – Prices

The prices are indicated in Euros and are valid for the territories of the European Union except DOM and TOM. They take into account any reductions as well as French VAT, applicable on the day of the order. Any order placed on the Site and delivered outside the European Union and to the DOM and TOM will be invoiced without VAT and may be subject to any taxes, customs duties and other related costs which are imposed when the package reaches its destination. destination. Section 4 – Order registration and validation

4.2 Registering an order

4.3 Final validation of the order and payment

In accordance with section 6. below, the Customer has a right of withdrawal and reimbursement, for a period of fourteen (14) working days from the date of receipt of the Products by the Customer.

4.4 Order Confirmation

A summary of the order will be displayed once the order has been validated. This confirmation will include all the constituent elements of the contract entered into between the Parties. This order summary will also be sent by email to the Customer within minutes of his purchase. The Customer will then have access to the “follow-up of his order” by clicking on “my account” and identifying himself with his e-mail address and password.

4.5 Modifying an order

The follow-up of orders placed is accessible from the “My account” menu. Section 5 – Shipping

5.1 Shipping times and methods

5.2 Delay / non-delivery

If, on the other hand, the parcel is not found at the end of the 21-day period of investigation, La Poste Colissimo considers the parcel as lost. In this case, Bacarella will send the Customer a replacement package, at its expense. If the lost product(s) were no longer available at that time, Bacarella would reimburse the Customer for the amount of these products.

5.3 Abnormalities

Any anomaly concerning the delivery (damage, open package, damaged package, broken products, etc.) must imperatively be indicated on the delivery note in the form of “handwritten reservations”, accompanied by the Customer’s signature. The Customer must immediately report the anomaly to Bacarella Customer Service so that a complaint can be made to La Poste Colissimo. Bacarella will return the replacement product(s) to the Customer, at its expense.

Section 6 – Return and right of withdrawal

The Customer has a right of return of fourteen (14) days from receipt of his entire order to withdraw without necessarily giving any reason. To exercise the right of withdrawal, the customer must notify his decision to withdraw his order by an unambiguous written statement specifying his name and surname, e-mail, address, number and date of order by e-mail.

In the event of withdrawal by the Customer on part of the Products of the order, Bacarella will reimburse the amount of the returned Products. The refund will be made by the same means of payment as the one the Customer used for his order or by bank transfer. Bacarella may defer this reimbursement until receipt and verification of the Products.
Return of products
The Customer must return the Products no later than fourteen (14) days after communicating his decision to withdraw. Returned products must be unopened, complete and undamaged. Section 7 – Computing and Freedom

If the Customer breaches these General Conditions and Bacarella takes no action, Bacarella will always be entitled to exercise its rights and remedies in all situations where the Customer violates the General Conditions.

Section 11 – Disputes

This contract is subject to French law. Bacarella cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from the misuse of the products marketed. In the event of difficulties in the application of this contract, the Customer has the option, before any legal action, of seeking an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other counsel of his choice. Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situation. In the event of a dispute, the Customer will first contact the company to obtain an amicable solution. In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, unless otherwise provided by law.
